I think it's more that male rape is just taboo, as men are not 'supposed' to be the victims of sexual assault. And male rape (and its victims) is also very much associated with homosexuality, still a taboo itself for many people around the world. So if one person asks for sex and is told no, it is sex being asked for and being refused, or accepted. Neither party intends to harm another person's humanity, then it is still a civil matter. BUT when one person disregards another's humanity, and assaults them intentionally, without their consent, they are committing an act of just that, assault. Thus, it is not treated as sex but as violence . Hence it is a criminal act and is prosecuted as such.So when us men go to our urologist for our rectal and prostate exams, the specialist is not performing sex on you, nor is he assaulting you. So he is not violating either the civil nor the criminal law.It is very easy to mix them up.
