So best case scenario, Trump loses this at a Supreme Court level. The powers that be are legit scared of Trump. They created a monster and are terrified they can’t control or destroy him no matter what happens. So there is a chance this sticks in the courts.
If that happens, expect riots and violence from the alt right who will see this as ‘taking away their freedoms’. This could rise to historic levels of unrest and since anyone raising up in big numbers will call down the wrath of the government’s standing anti-civilian military (police and national guard). I wouldn’t mind at all if the far right impale themselves on their own. This would drain the alt right support across the country and lead to a progressive movement that sweeps the nation.
Like I said, best case scenario and wishful thinking.
If the SCOTUS does not rebuke the Colorado ruling - look for the other 49 states to immediately file their own cases which replicate the Colorado Manuever.

The spineless part is when moderates suddenly want to falter and play the fence when it comes to holding politicians accountable, especially Trump. Somehow they still try to find a way to play both sides of the fence. You're seriously campaigning for fairness for a person who takes every waking moment to take a fat shit on fairness, and everything else that's sacred to a democracy? And since when is accountability unfair, especially when it's applicable?
Several aspects of the constitution are outdated, but are still applied to modern issues when convenient.

The BLM movement, kids stepping up and getting into politics in huge numbers, exposing the effects of fostering subtle racism into full blow racist movements… this caused a massive call for change.
Then the Democrats do what they do, marched into office on the winds of change and put a stop to that right away. The voices died down as they waited for the change to happen and now as we close in on the end of Biden’s term it’s nearly dead. The melancholy of the left is just as if not more destructive than the hate on the right. Republicans and Democrats functionally run the country the same way, but Republicans do it more overtly and it angers people.

If we're being honest, the democrats aren't being subtle. Their whole thing has been "Hey, we're fucking you in pretty much all the same ways as the repubs, but at least we're not repubs, right?" I'll concede that Trump's presidency forced everyone to show their hands. But not many of us lefties are naive enough to believe that the democratic party is worth a damn, nor has it been for quite some time. Again, Trump's presidency made the denial of this fact willful instead of misinformed.

It's written by Larry Lessig, who used to be my favorite 2016 candidate in the Democrat primaries.
I can't judge the validity of his claims about the 14th amendment, but the idea that the chance of triggering a civil war should be an argument to keep Trump on the ballot is just silly. Doing away with democracy seems like the recipe for civil war.
And to be fair, I don't think he's actually making that point. The way I read it is that he argues that removing Trump from the ballot is unconstitutional, and that doing so might trigger a civil war because it is unconstitutional.

14th is a pretty much unused and undefined amendment. It is so broad in it’s interpretations that it’s functionally useless until a precedence in higher courts is set as to what it means.
Another way the precedence based legal system is total garbage, by the way.
It allows one case to set the tone for all the others so you just need to push through to a bought off upper court to set laws.

This is actually not true. There are tons of ways courts can enforce rulings against people not convicted of crimes.
Simple example, restraining orders. One citizens protection takes precedence over another’s process of a trial. Minimal evidence must be provided to get a restraining order and the person has an opportunity to fight it but it can remain in place in the meantime.
There are tons of court procedures, penalties, and failsafes that offer protections while the slow wheels of courts turn. This is especially important when people like Trump’s primary legal philosophy is dragging out every step as long as possible.
I for one, know how fickle the US Court system can be. But l still believe that Colorado is misusing the 14th Amendnent without an actual conviction to stand on. It is opening the door for unforeseen misuse that can be very detrimental to democracy and the Constitution.
Trump needs to be defeated at the polls by the voters. This court action will just give more energy to the Trump cult. Trump us an old man, and it is even possible nature may take its' course with him. But he does seem to lie and cheat without any physical stress, as if it comes easily without a moral conscious. Most people would suffer physically from feeling guilt, but not Trump, who has no moral compass.
As far as the courts, l did have great success in winning a lawsuit in which l was the plaintiff. And l did collect the entire financial award.
But l know many victorious lawsuits in court never collect the financial award - never!
This seems like an opinion more than a legal theory. Like I said, restraining orders protect without conviction. As it’s immensely untested and undefined the 14th amendment has interpretations that it can act like a restraining order from public office. Like how it was used after the Civil War to prevent the southern states from simply re-electing the same leaders that led the insurrection. Most were never convicted of a crime but still denied public office.
