I want to write a story and to make a point of context the main character is the son of a famous (well famous to me) character from a tv show. the tv show character will be mentioned once in the introduction and then never again. it is not a fan fiction or a spin-off from the original show. can i use that?

as i have said, it will not be fan fiction or anything to do with the character of the tv show, just mentioning him in relation to my character

i like it. just make sure the girls are 16+ when you write it. also, there's a character in Oliver Twist called Master Bates and one called Mr. Dick in David Copperfield. smile

I always thought famouse people were fair game, but characters were not, because that would be fanfic. So I could use Jennifer Anniston (and would love to..) but NOT Rachael Green in a story.

I don't think either case would be allowed as there are rules here against stories containing famous people OR derivative works.

I think this is because with a fictional character you might infringe copyright (the derivative bit), while a real person would be protected by libel laws.

This is getting so confusing to me. Are we not even allowed to mention real people in our fictional stories? If I write a story about ballet can I not mention Baryshnikov just to say he is a famous dancer? If I write a story about famous murderers can I not mention a real serial killer now on death row? Or am I missing something?

Maybe they need to be dead now?

. ok, to clear up the confusion here - i think even my mods get confused at times. lol Real people can be mentioned, they can be referenced - what we would prefer, is that they are not mentioned as part of any sexual element, ie:

this is ok - I ran into Brad Pitt at Burger King. I told him I loved his new movie. He said thank you and signed an autograph.

Or: I love Brad Pitt's new movie. He's super hot. I have his poster in my room.

As I understand it, though, characters could only be mentioned in the context of, "Jaime Lannister was hot in Game of Thrones," in essence, speaking if him as a cultural reference, not as a living person in your story. That would be public domain. If he were referenced as a living person, your story would, by default, be happening in that world, so the copyright would be infringed.

Would that be correct?

What about Porn Stars? I have seen a few stories where Porn Stars are actually in the story, full name, body and everything. Are they allowed because they are already in the so called "biz" or is that a no?

I know you can't reference a famous person, but I am sure we can say our character looks like Rachel Green from that popular sitcom, or is that still a no, because again I have seen that type of description used many times. We aren't saying the character IS Rachel Green, but her outward appearance is similair.

Just clearing a few things up for a future story I am trying to write without breaking any rules.

I would assume porn stars would still fall under the no celebrities rubric myself. Possibly the mods who passed those stories didn't know their porn stars well enough to catch it? Certainly I am largely in the dark about who is big in porn today (my porn heyday was the early nineties through early noughties).

And the "similar to" is allowed, IIRC, but wait for a mod ruling. It's been years since my time backstage. After all, people say it about other people all the time (Hey, you look like ...).
